The petitioner alleges violation of the direction passed in the order dated November 5, 2019.
It appears from the contempt application that the contemnor no. 1 has passed an order on January 3, 2020 allegedly in compliance of the order of this Court dated 5th November, 2019.
According to the petitioner the order has not been carried out in terms of the direction passed by the Court. The petitioner submits that even though there are enough vacancies the petitioner has not been promoted in the higher post.
I am afraid that the aforesaid submission of the petitioner cannot be looked into by the Court sitting in contempt jurisdiction.
Accordingly, the instant contempt application stands disposed of.
The petitioner will be at liberty to challenge the order passed by the contemnor no. 1 before the appropriate forum, in accordance with law, for redressal of his grievances, if so advised.
The affidavit-of-compliance and the exception thereto by the petitioner be retained with the records. Urgent photostat certified copy of this order, if applied for, be given to the parties after completion of all legal formalities.
