1. Affidavit-of-service, filed by the learned Counsel for the petitioner in Court today, is taken on record.

2. Ms. Kakali Dutta, learned counsel appears for the petitioner.

3. None appears for the respondents/State despite service.

4. Mr. Pantu Deb Roy, learned Additional Government Pleader who generally appears in this type of matters is present in Court today. He wishes to appear in this matter for the respondents/State. He shall appear with other State counsels who are already engaged in this matter. His appearance shall be regularized accordingly.

5. Learned counsel for the petitioner shall furnish a copy of the writ petition upon Mr. Pantu Deb Roy, learned Additional Government Pleader.

6. Heard the parties at length through their respective counsels.

7. Apropo the facts of the case, a permanent stage carriage permit was issued by the respondent no.3 in favour of one Parbati Sarma in respect of the route Burdwan Court to Uday Pally via Golapbag, Rathtala, Tikorhat, Rajbati, Rabindrabhaban (Town Service).

8. Thereafter on 25.8.2020 as per the resolution of the RTA Board the said permit was transferred in favour of the petitioner and on the basis of such transfer of permit, the petitioner commenced to ply his vehicle bearing No.WB-41C/0891 and the permit dated 25.8.2020 was renewed upto 19.9.2025.

9. The petitioner states that he has been plying his vehicle on and from 25.8.2020 in the route in question and the same had expired on 19.9.2025. He made a representation dated 22.8.2025 before the respondent no.3 for renewal of the permit but the same has been kept pending for consideration. 10.

After hearing the rival contentions of the parties and perusing the materials available on record I direct the respondent no.3 to consider the representation dated 22.8.2025 being Annexure-P3 at page 14 to the writ petition and to pass a reasoned order in accordance with law after affording an opportunity of hearing to all the interested parties within four weeks from the date of communication of this order and shall communicate the said reasoned order to all the

interested parties accordingly within a week thereafter.

11. However, it is needless to mention that upon hearing the parties if the respondent no.3 finds that the petitioner is entitled to get his permit renewed then the authority concerned shall forthwith take appropriate steps in accordance with law.

12.The writ petition stands disposed of without expressing any opinion on the merits of the case. 13.There will be no order as to costs.

14.The parties shall act on the server copy of this order duly downloaded from the official website of this Court.
