Mr. Mayukh Mukherjee, Mr. Sarthak Mondal ...for the petitioner Mr. Shibaji Kumar Das, Ms. Rupsa Sreemani ...for the respondent nos. 6, 7 and 8 The petitioner complains of inaction by the Chakdah Police Station, Nadia in respect of an FIR being Chakdaha P.S. Case No. 560/22 dated August 23, 2022. The FIR was registered on the direction of the local Magistrate under Section 156(3) of the Cr. P.C.
The petitioner claims that the police have failed to record statements of witnesses or include sections relating to extortion and forgery.
The Chakdah Police Station, Nadia has filed a report dated 30.01.2023 stating that charge sheet no. 557/22 dated September 9, 2022 under Sections 447/323/354/34 of the IPC has been filed against several persons.
The petitioner's remedy is, therefore, under Section 173(8) of the Cr. P.C.
With the aforesaid observations, the instant writ petition along with CAN 1 of 2023 shall stand disposed of without any further order.
The report of the Chakdah Police Station, Nadia dated 30.01.2023 be kept with the record. There shall be no order as to costs.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
