Affidavit of service filed in Court today is taken on record.

The petitioner is aggrieved by the proceeding initiated by the Sub-Divisional Officer, Ghatal for causing enquiry of the caste certificate issued in his favour.

The petitioner was directed to appearing in a hearing before the Sub-Divisional Officer. Instead of appearing before the said Officer, the petitioner has challenged the action of the Sub-Divisional Officer by filing the instant writ petition.

Learned advocate appearing on behalf of the petitioner submits that the Sub-Divisional Officer ought to conduct the enquiry himself instead of relegating the same to the Block Development Officer.

Learned advocate appearing on behalf of the State respondents has obtained instruction from the Sub-Divisional Officer wherefrom it appears that the petitioner is not appearing in the hearing fixed by the officer.

From the communication dated 6th June, 2023 annexed to the writ petition at page 36, it appears that the Sub-Divisional Officer directed the Block Development Officer to cause a field enquiry and send the report to the Sub-Divisional Officer for further necessary steps.

It is noticed that the Block Development Officer has not passed any order in the matter. The Sub-Divisional Officer merely requested the Block Development Officer to conduct the enquiry as per the updated guidelines of the State.

The instant writ petition is disposed of by directing the petitioner to cooperate with the hearing conducted by the Sub-Divisional Officer. In the event the petitioner has any grievance with the proceeding, the petitioner ought to raise the same before the SubDivisional Officer where the matter is pending consideration.

The writ petition stands disposed of.

10. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
