1. Let affidavit-of-service, as filed in Court, be kept on record.

2. The petitioners are unable to repay a loan taken from the Cooperative Bank, sometime in 2023, for an aggregate sum of Rs.8 lakhs.

3. The grievance of the petitioners is that the inability to pay the loan emanates from the concerned authority not acting in terms of the National Livestock Mission under which the

petitioners are entitled to get 50% capital subsidy from the Central Government.

4. Petitioners, thus, pray for waiver of 50% of the loan amount by the respondent, Co-operative Bank.

5. Mr. Sengupta, learned Advocate appearing for the respondent Bank, submits that by a letter of February 13, 2023, a copy of which is kept on record, the petitioners agreed to take the loan from the respondent Bank, irrespective of whether they get any subsidy from the Central Government or not, as stipulated under the National Livestock Mission.

6. Parties have raised a dispute, which falls squarely within the ambit of Section 102 of the West Bengal Cooperative Societies Act, (hereinafter referred to as the "said Act").

7. Petitioners are at liberty to approach the concerned Registrar under Section 102 of the said Act to ventilate their grievance, which will be dealt with in accordance with law by the concerned Registrar.

8. With the aforestated direction, the writ petition is disposed of.

9. There shall, however, be no order as to costs.

10.Since no affidavit has been called for, the allegations contained in the writ petition are deemed to be denied.

11.Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
