28.09.2022 tkm/ct 28 C.R.M. (DB) 3351 of 2022 sl no. 83 In Re : An application for bail under section 439 of the Code of Criminal Procedure in connection with Dhantala Police Station Case No. 537 of 2022 dated 28.07.2022, under sections 363/365/34 of the IPC and section 6 of the Protection of Children from Sexual Offences Act. And In Re : Anup Halder alias Sanjoy Halder ........ petitioner Mr. Angshuman Chakraborty, Mr. Shashanka Shekhar Saha ...... for the petitioner Mr. Arijit Ganguly, Mr. Anik Ghatak ...... for the State It is submitted on behalf of the petitioner that there was a love affair between the parties. He prays for bail. Learned lawyer for the State opposes the prayer for bail. We have considered the materials on record. Statement of minor victim does not disclose any relationship between the parties. On the other hand, she states she was forcibly kidnapped and married.

Under such circumstances, we are not inclined to grant bail to the petitioner at this stage.

Accordingly, the prayer for bail is rejected. (Ajay Kumar Gupta, J.) (Joymalya Bagchi, J.)
