IN THE HIGH COURT AT CALCUTTA

CIVIL REVISIONAL JURISDICTION APPELLATE SIDE C.O. 3061 of 2022 Bhudev Bag Vs.

Rina Bag (Khanra) Mr. Mahammad Mahmud ...for the petitioner

1. Present petition has been filed challenging the order dated 17th March, 2022 and 22nd April, 2022. Vide order dated 17th March, 2022, an application being moved by the opposite party / wife, the venue of meeting was changed from the Chamber of the learned advocate to Chaitalpara Park, near Model School.

2. Learned counsel submits in the order there was no mechanism for monitoring the meeting of the child. Admittedly, the petitioner had not approached the concerned Court of learned Additional District Judge, Fast Track Court, 1st Court, Howrah, bringing this fact to the notice of the learned Trial Court.

3. By present petition, the order dated 22nd April, 2022 has also been challenged. However, the

perusal of the order does not indicate any ground on which the same could not have been challenged.

4. The Court considers that at the outset the present petition does not even merit any consideration. The High Court in its revisional jurisdiction can interfere only if there is some illegality or perversity. There is no illegality or perversity in the order of the leaned Trial Court.

5. Hence, the petition is disposed of. However, liberty is given to the petitioner to move an appropriate application for laying down the mechanism for meeting in terms of the order dated 17th March, 2022.

6. Since the main suit and the miscellaneous proceedings are of the year 2012 and 2018 respectively, the learned Trial Court is requested to expedite the matter in accordance with law.

7. The present petition is disposed of.

8. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
