Affidavit-of-service filed by the petitioner be kept with the record.

Petitioner is aggrieved by the fact that the private respondents are involved in dismantling the trees of the petitioner and also obstructing in peaceful enjoyment of the property.

Learned advocate for the private respondents submits that the respondent no.4 has already expired. So far as the other respondents are concerned, the accusations are denied and disputed and submitted that since no affidavits have been called for, the allegations are deemed not to have been admitted.

State has submitted a report. Report reflects that a proceeding has been drawn under Section 126 of the BNSS.

Having considered the steps taken by the police authorities, I direct that the police authorities would oversee and keep a continuous surveillance so that further interference and/or breach of the peace do not take place. However, the aforesaid order is not an indication relating to the right, title and interest of any of the parties.

With the aforesaid observations, WPA 22111 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

Copy of the report be handed over to both the parties.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
