10.10.2023 AGM In The High Court At Calcutta Constitutional Writ Jurisdiction Appellate Side W.P.A 21893 of 2023 Gangamoni Senapati -versus The State of West Bengal & Ors.

Mr. Bhaskar Chakraborty Mr. Subrata Mukherjee ... For the petitioner.

Mr. Indranil Roy Mr. Tapas Kr. Mondal ... For the State.

Mr. P. K. Roy Mr. Ankit Sureka Mr. P. S. Pal ... For the respondent no. 2 and 3.

Mr. Manoranjan Jana ... For the respondent no. 7.

Mr. Madan Mohan Roy ... For the respondent nos. 4 and 5.

The petitioner seeks consideration of the representation filed on her behalf before the Balageria Central Co-operative Bank Limited.

It appears that certain amount of money is lying with the bank and the petitioner claims 1/3rd share of the same.

Learned advocate representing the private respondents i.e. the widow and child of the deceased opposes the prayer of the petitioner.

Without entering into the merit of the claim and counter claim of the parties, the instant writ petition is disposed of by directing the Branch Manager of the bank to consider and decide the representation filed on behalf of the petitioner in accordance with law at the earliest after giving a reasonable opportunity of hearing to all the necessary parties.

Keeping in mind the advanced age of the petitioner, the Branch Manager is directed to take a decision at the earliest but positively within a period of eight weeks from the date of communication of this order.

The parties will be entitled to rely upon all documents in their support.

A reasoned order shall be passed and communicated to all the parties immediately thereafter. Learned advocate for the petitioner is directed to forward copy of the legal representation seeking consideration to the Branch Manager at the time of communicating the order of the Court.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
