In view of the innocuous nature of the prayer made, prior service of notice on the Opposite Party is not being directed.

The plaintiff in an eviction suit filed in the year 2010 has filed the present petition under Article 227 of the Constitution of India seeking expeditious hearing of the matter.

It is submitted that an application under Sections 7(1) and 7(2) of the West Bengal Premises Tenancy Act, 1997, along with an application under Section 5 of the Limitation Act, are pending for an inordinately long period, thereby delaying the disposal of the suit.

In such view of the matter and also keeping in mind that the petitioner is in his sixties, CO 3209 of 2024 is disposed of by requesting the learned Civil Judge (Junior Division), 1st Court at Baruipur, District - South 24 Parganas to dispose of the

pending applications under Sections 7(1), 7(2) of the 1997 Act as well as Section 5 of the Limitation Act as well as other pending applications, if any, filed in connection with Title Suit No. 4 of 2010, pending before the said court, as expeditiously as possible, positively within four weeks from the date of communication of this order to the said Court. 5.

There will be no order as to costs.

The parties and all concerned shall act on the server copy of this order without insisting upon prior production of any certified copy for the purpose of compliance.
