After hearing learned counsel appearing for the petitioners and the respondent, it appears that there is a discrepancy in the dates of disbursement mentioned in the particular annexure to the effect filed by the petitioners under Section 14 of the SARFAESI Act, 2002 and a calculation sheet handed up by learned counsel appearing for the respondent.
Since the figures mentioned in the two documents vary, W.P.A.22314 of 2022 is disposed of with liberty to the petitioners to ascertain and rectify the correct dates of disbursement and file affidavit before the District Magistrate, Howrah. The District Magistrate will then dispose of the application within three weeks from the date on which the rectified documents are received from the petitioners. The District Magistrate is directed to do the needful within the time directed since the petitioners faced an earlier rejection on 6th May, 2022.
The petitioners shall be at liberty to file supplementary affidavit before the District Magistrate, Howrah.
