19.09.2024 AD-39 Court No.29 TN CRM (A) 3373 of 2024 In Re:- An application under Section 438 of the Code of Criminal Procedure, 1973 corresponding to Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Marishda Police Station Case No. 148 of 2024 dated 23.04.2024 under Sections 498A/304B/302/34 of the IPC read with Section 4 of the Dowry Prohibition Act.

1. The learned counsel for the petitioners submits that subsequent to the order of rejection, charge sheet has been filed in which Section 302 has been omitted.

2. It is submitted that the husband has been enlarged on bail.

3. We have carefully read our order. We have stated that the case diary revealed incriminating materials against the petitioners which ultimately led to the victim committing suicide and prima facie all the petitioners are responsible for the death of the victim. There is no change in circumstances.

4. Hence, this application for anticipatory bail of the petitioners is rejected.
