Alauddin Sha v. State Of West Bengal
14.11.2025 Court No.28 Item No.21 tbsr Reject CRM (A) 3334 of 2025 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Hare Street P.S. DD Case No. 92 of 2025 dated 01.05.2025 under Sections 61(2)/318(4)/338/336(3)/340(2) of the BNS. And In the matter of: Alauddin Sha ....Petitioner.
Md. Basir Layek Mr. Kalyan Mitra ....for the petitioner Mr. Rudradipta Nandi Ms. Mousumi Sarkar ....for the State Learned counsel for the petitioner submits that the petitioner was not named in the FIR. He has been falsely implicated in this case. So far as his loan is concerned, reliance is placed on a loan closure letter.
Learned counsel for the State strongly opposes the prayer for anticipatory bail, refers to the voluminous case diary and submits that the petitioner and some others were acting as agents for the bank. They brought some borrowers who were issued loans on the basis of forged documents and thereafter a specific part of the loan taken was transferred to the bank account of the petitioner. There are three instances where such was the modus operandi. Considering the above and the incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.
Accordingly, the application for anticipatory bail is rejected. (Jay Sengupta, J.)
