For the State Ekramul Bari Sk. Imtiajuddin .... For the Respondent no. 8 The petitioner has prayed for implementation of the order dated 22nd July, 2024 passed by the District Magistrate, Dakshin Dinajpur. In an earlier writ petition being WPA 25138 of 2024 the private respondent herein prayed for setting aside the same order.

Though this writ petitioner was not represented in the said writ petition, by an order passed on 16th January, 2025 a co-ordinate Bench of this Court directed the Director of Health Services, Government of West Bengal to revisit the issue upon granting opportunity of hearing to the writ petitioner and the 8th respondent herein and allowing them to place relevant material before him. Since the issue has been sent to the Director of Health Services, Government of West Bengal, being the 3rd respondent herein, for fresh consideration, the question of implementation of the said order does not arise till the matter is considered afresh by the concerned authority.

Court, the petitioner and the 8th respondent shall be granted an opportunity of hearing before the concerned authority, being the 3rd respondent herein, at the time of hearing and shall be at liberty to produce relevant documents in support of their respective contention. In view thereof, no further order is required to be passed in the present application.

The application is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
