The petitioner has prayed for expeditious disposal of Misc. Execution Case No. 170 of 2022 which is pending before learned Judicial Magistrate, 1st Court, Alipore. According to the petitioner, there are arrears of Rs.1,30,000/- and the husband happens to be a government employee who is purposely denying such maintenance from being regularly paid.

Having considered the factum that the lady has been knocking the door of this Court for a considerable period of time, I direct the learned trial court to fix and grant four instalments at a stretch of 45 days for clearing the whole amount of Rs.1,30,000/-. There should not be any deviation from the aforesaid schedule. In case the husband denies and/or by any means tries to stretch the time, the learned court will not deter to take harsher steps by directing the concerned Deputy Commissioner of Police of Eastern SubDivision to execute the warrant within 48 hours. The time period, so referred to above, must be strictly adhered to.

With the aforesaid observations, the revisional application being CRR 3479 of 2023 is disposed of.

Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
