1. It is submitted on behalf of the petitioner that he is in custody for five months. It is further submitted petitioner is not the principal accused. Accordingly, he prays for bail.

2. Learned Advocate for the State submit petitioner had held the victim while Jony assaulted him resulting in his death.

3. In view of the active role played by the petitioner in the crime, we are not inclined to grant bail to the petitioner at this stage.
