After hearing the learned advocates for the respective parties and upon going through the averments made in the said application, this Court is satisfied that the petitioner was prevented by sufficient cause for not appearing on 7th January, 2026 when the writ petition stood dismissed for default. Accordingly, the order dated 7th January, 2026 stands recalled.

The writ petition is restored to its original file and number.

CAN 1 of 2026 stands allowed.

WPA 22309 of 2025 The writ petition is taken up for immediate consideration.

Mr.

Dutta, the learned advocate appearing for the petitioner submits that the private respondent nos. 9 and 10 are carrying on the business of manufacturing bricks without obtaining requisite clearances from the West Bengal Pollution Control Board and without having any licenses from the local body.

Such submissions is disputed by the learned advocate appearing for the respondent nos. 9 and 10. He files a bunch of documents, in support of his contention that the private respondent nos. 9 and 10 are running the business of brick field upon obtaining the consent to establish and the consent to operate from the West Bengal Pollution Control Board. After going through the said documents this Court returns the same to the learned advocate for the petitioner with a direction to file the same in course of this day. The learned advocate appearing for the petition is also directed to serve photocopies of such documents to the learned advocate for the the State in course of this day.

The report of the Inspector-in-Charge, Kulti Police Station dated 22nd September, 2025 filed by the learned advocate for the State is taken on record. The said report specifically states that the brick field in the name and style of "Raja Bricks" or "SSB Bricks" is not functional on the scheduled land till date.

Mr. Dutta, learned advocate appearing for the petitioner seeks time to go through the said documents and revert back with instructions.

On the prayer of Mr. Dutta, learned advocate appearing for the petitioner, list this matter on 9th April, 2026 under the heading "Motion".
