1. Affidavit of service filed in Court today is taken on record. Learned advocate appearing for the petitioners submits that the opposite parties have been duly served.

2. This is an application for expeditious disposal of Title Execution Case No. 12918 of 2013, which is pending before the learned Civil Judge (Senior Division), 4th Court at Alipore.

3. Learned advocate appearing for the petitioners submits that the petition dated April 20, 2023 was heard-in-part on July 13, 2023 as well as on October 7, 2023. He further submits that the next date has been fixed on February 3, 2024 for hearing of the petition dated April 20, 2023.

4. It appears from records that a Misc. Case No. 3 of 2017 is also pending.

5. In view of the aforesaid submission of the learned advocate for the petitioners, C.O. 3191 of 2023 is disposed of by requesting the learned Civil Judge

(Senior Division), 4th Court at Alipore to take up hearing of the petition dated April 20, 2023 on the next date fixed i.e. on February 3, 2024 and to dispose of the same as expeditiously as possible but preferably within a period of six weeks from the next date fixed without granting any unnecessary adjournment to either of the parties.

6. The learned Executing Court is further directed to dispose of the Misc. Case No. 3 of 2017 as expeditiously as possible, if the same is otherwise ready for hearing.

7. No costs.

8. Urgent photostat certified copy of this order, if applied for, be given to the parties expeditiously upon usual formalities.
