C.R.M. (M) 1710 of 2025 In Re : An Application under Section 439 of the Code of Criminal Procedure/under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Kaliyaganj Police Station Case No. 159 of 2025 dated 26.04.2025 under Sections 103(1)/3(5) of the Bharatiya Nyaya Sanhita.

Ms. Subhasree Patel Mr. Sourat Nandy ... For the State Learned counsel for the petitioner submits that the petitioner is in custody for 100 days. He has been falsely implicated. He has to appear for his XIIth standard pre-test and his future shall be ruined if he is not granted bail. Learned counsel for the State opposes the prayer. I have considered the material on record. Eye witnesses have implicated the petitioner.

Sufficient incriminating material has transpired against him during investigation. Charge sheet has been submitted. Considering the material on record and extent of involvement of the petitioner in the alleged offence, prayer for bail is rejected at this stage.

Since the petitioner seeks to write his XIIth standard pre-test, he shall submit an application before the Superintendent of the correctional home along with relevant documents pertaining to the said examination.

The

Superintendent shall consider the said documents and also consider making necessary arrangements so that the petitioner is able to write his examination from the correctional home.

The application for bail is disposed of.
