Learned Advocate for the State opposes the prayer for bail.
We have considered the materials on record. On the leading statement of the petitioner narcotic substance above commercial quantity, that is, 100 bottles of phensedyl syrup containing codeine phosphate was recovered. Recovery has been witnessed by independent persons.
In view of the aforesaid incriminating materials and statutory restriction under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected.
