Report submitted by the CID, West Bengal be kept with the record. Record reflects that a reply was received by the CID, West Bengal from the Senior Superintendent of Police, Gaya, Bihar informing that in respect of the missing of the mother of the present petitioner Vishnupada Police Station Case No. 277/24 dated 27.09.2024 has been registered for investigation under section 137(2)/140(3) of BNS. Details in respect of the steps taken are also reflected in the report. The case is presently under the supervision and seisin of the Court at Gaya. Police authorities of Gaya are exerting their efforts in respect of the case and the lady had gone missing according to the FIR from Gaya itself.

Having considered the present status, I am of the view that the petitioner would pursue his remedies with Vishnupada Police Station Case No. 277/24 and the Court which is in seisin of the said case.

The High Court of the concerned State will obviously have jurisdiction and it would not be in the fitness of judicial discipline to interfere with the administration of another State.

So far as the plight expressed by the petitioner in respect of threats at the behest of the private respondents, the local police authorities on being informed would take steps in accordance with law. If so complained, the police authorities would oversee that there is no insecurity instilled at the behest of the private respondent in respect of the issues associated with the writ petition.

With the aforesaid observations WPA 22740 of 2024 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
