It is submitted no narcotic substance was recovered from his possession. Mr. Maity, learned Advocate for the NCB submits petitioner and co-accused were dealing in narcotic substance above the commercial quantity. Investigation is in progress. CDRs show telephonic conversations between the petitioner and the co-accused from whom narcotic substance was recovered.
We have considered the materials on record.
Investigation is in progress. Telephonic conversations shows communication between the petitioner and the co-accused on or about the time the offence was committed.
As investigation is still in progress and other incriminating materials may emerge, we are not inclined to grant bail to the petitioner at this stage.
Accordingly, the prayer for bail of the petitioner is rejected.
