The petitioner has preferred this revisional application for expeditious disposal of Case No. A.C. 4074 of 2019 which is under the provision of Section 12 of the Protection of Women from Domestic Violence Act, 2005.

Learned advocate appearing for the petitioner submits that earlier an application for interim relief was dismissed, but subsequently another application has been taken out. Learned court has fixed a date on 29.09.2023 for hearing of the said interim application.

Having regard to the fact that the present case was initiated in the year 2019, I direct the learned Judicial Magistrate, 2nd Court, Alipore to dispose of the application for interim relief on the next date so fixed or within a fortnight thereafter. The learned court would thereafter takes steps for proceeding with trial of the case by fixing at least one date in a month so that trial of the case can be taken to its logical conclusion within a reasonable period of time. Having regard to the object with which the provision of the Protection of Women from Domestic Violence Act, 2005 has been incorporated and the wider amplitude for protection of the aggrieved party, the learned trial court is directed to

see that intention of the legislation is given effect to in such cases.

All efforts be taken to conclude the trial of the case at the earliest.

With the aforesaid observations, the revisional application being CRR 3486 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
