Mr. Mukherjee, learned counsel appearing on behalf of the West Bengal State Electricity Distribution Company Limited (WBSEDCL) submitted on the previous occasion that the present writ petition has been filed in gross suppression of material facts. In W.P.A. No. 8587 of 2023, this Court passed an order rejecting the same prayer vide order dated May 2, 2023. Such order was not brought on record in the present writ petition.

Mr. Sarkar, learned counsel appearing on behalf of the petitioner tenders unqualified apology in Court today. He submits that he was not aware of the fact that his client filed a previous writ petition on the selfsame cause of action.

In such view of the matter, W.P.A. No. 21931 of 2023 is dismissed.

It is made clear that this Court has not at all appreciated the conduct of the petitioner.

There will be no order as to costs.

All parties shall act on a server copy of this order duly downloaded from the official website of this Court.
