Mr. Kushal Chatterjee Mr. Suman Chakraborty.............for the petitioners This application under Article 227 of the Constitution of India is at the instance of 1st, 9th and 10th defendant praying for expeditious disposal of the suit being Partition Suit No. 122 of 2021 pending before the learned Civil Judge (Senior Division), Berhampore, Murshidabad.

It appears from the order dated 3rd December, 2022 that 11th May, 2023 was fixed for filing of the written statements by the defendants. The learned advocate for the petitioners submits that the 1st, 9th and 10th defendant have already filed their written statements but the other defendants are yet to file their written statements.

In view thereof, C.O. 3193 of 2023 is disposed of by requesting the learned Civil Judge (Senior Division), Berhampore, Murshidabad to dispose of the Partition Suit No. 122 of 2021 as expeditiously as possible without granting any unnecessary adjournment to either of the parties.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties expeditiously upon usual formalities.
