The revisional application has been preferred against the order dated 18.07.2019 passed by the Learned Judicial Magistrate, 9th Court, Alipore, in connection with Misc. Case No. ACM 183 of 2016 under section 125 of the Code of Criminal Procedure.
None appears on behalf of the petitioner when the matter has been called.
Learned advocate for the opposite party no.2 is present. I find from the order dated 18.07.2019 that the learned Magistrate was pleased to dispose of the application by awarding interim maintenance of a sum of Rs.5000/- to be paid to the petitioner.
Having regard to the fact that the order was passed by way of an interim measure during the final disposal of the proceedings under Section 125 of the Code of Criminal Procedure, I am of the view that no interference is called for at this stage. The learned Magistrate is directed to expedite the proceedings so that the final outcome of the case may be arrived within a year from the date of communication of this order.
With the aforesaid observation, CRR 3185 of 2019 is disposed of.
All pending applications, if any, are consequently disposed of.
Interim order, if any, is hereby vacated.
