When the matter is called on today, we have been handed a copy of the instruction by the learned advocate for the State. As per the instruction dated 06.11.2025, the competent authority in the Department of Health & Family Welfare, Government of West Bengal has already decided to accept the petitioner's resignation dated 01.10.2024, with effect from 01.09.2025. The petitioner submitted his resignation from the post of Associate Professor in the Department of Psychiatry, Jalpaiguri Govt. Medical College, Jalpaiguri.

Since resignation was accepted, now only an integrity clearance is awaited from the State Vigilance Commission, West Bengal. Similar clearance is also to be issued by the Vigilance Branch of the Health & Family Welfare Department, Government of West Bengal.

The learned advocate submits that the authorities are taking appropriate steps for completing these

formalities and other formalities as per the extant rules.

Such submission is founded on the instructions communicated in the letter dated 06.11.2025, which is kept on record.

In view of such instructions and submissions, there is no dispute that the writ petition has become infructuous.

We, however, observe that the authority has not communicated any timeline for completing the other formalities, noted above.

We are, therefore, not inclined to accept an openended assurance as contained in the communication dated 06.11.2025.

We consider it appropriate that the authority should take steps to expedite the necessary clearance, noted above and completion of formalities as per extant rules, preferably within a period of four weeks from the date of receipt/production of a copy of this order before the respondent no.3.

The Writ Petition is disposed of in these terms.

10. The parties are in agreement that in view of the present order in this proceeding, O.A. No. 506 of 2025, pending before the West Bengal Administrative Tribunal has also become infructuous. Accordingly, the O.A. No. 506 of 2025 also stands disposed of.

11. There will be no order as to costs.

12. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
