It is the grievance of the petitioner that despite making an application for a separate electricity connection to his premises, WBSEDCL has not provided the same.
Learned Advocate appearing for WBSEDCL submits that due to resistance by the respondent no. 3, the connection could not be effected. Learned Advocate appearing for the respondent no. 3 submits that respondent no. 3 has already obtained a decree of eviction against the petitioner and that execution proceedings have already been initiated. Learned Advocate for the respondent no. 3 further submits that the petitioner has no right, title or interest over the property in question and, in view of the decree passed by the learned Civil Judge, the
petitioner is not entitled to get an electricity connection.
I am, however, unable to accept such contention.
The petitioner's possession over the premises in question is not disputed. Since the petitioner is in possession, I am of the view that he is entitled to get an electricity connection, regardless of the pendency of the execution proceedings against him.
Accordingly, WBSEDCL is directed to effect the electricity connection to the petitioner's premises, subject to compliance with all requisite formalities by the petitioner, within a period of three weeks from date.
The Officer-in-Charge of the local police station shall render necessary assistance to the officials of WBSEDCL at the time of effecting the connection, and the petitioner shall bear the cost of such police assistance.
It is made clear that the grant of electricity connection shall not create any right whatsoever in favour of the petitioner, nor shall the same have any bearing on the pending execution proceedings initiated by respondent no. 3 against the petitioner. The executing court shall proceed in accordance with law, without being influenced by this order.
Accordingly, WPA 22950 of 2025 is disposed of.
