Learned advocate appearing for the petitioner is directed to serve copy of this revisional application upon Mr. Pravas Bhattacharya, learned advocate, who ordinarily appears for the State. His appointment may be regularised by the concerned authorities.

Records of the case reflect that the case is of the year 2013 and the subject-matter of proclamation was concluded on 06.05.2023. Learned advocate for the petitioner submits that as whole of the village was implicated, the petitioner unknowingly had been implicated and he came to know regarding the same after the proclamation was issued. It has also been submitted that his life and liberty would be jeopardized, if he is taken into custody.

Be that as it may the execution of the proclamation so issued be stayed for a period of six weeks. In the meantime, the petitioner is granted liberty to exhaust his remedies before the appropriate forum.

The learned Additional Chief Judicial Magistrate, Rampurhat, Birbhum would revive the said order of proclamation on the third week of November 2023.

With the aforesaid observations, the revisional application being CRR 3489 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
