Report submitted by the learned advocate appearing for the State be also kept with the record. Petitioner complains that there has been unusual interference by the police officials of Amherst Street Police Station.

I find that the police authorities have been repeatedly calling the petitioner in respect of a complaint which has been submitted on 07.08.2025 by one Ram Jaiswal. Police authorities did not register a case, but has been repeatedly calling the petitioner.

Having considered that no criminal case has been registered and the nature of the complaint is for a sum of Rs.22,25,000/- for which the informant has claimed that he has been cheated, I am of the view that the police authorities, if they are of opinion that any case is made out, they would take a decision on that. In the alternative

under the garb of information sent in a commercial transaction or in respect of any amount of money being handed over to the petitioner, police authorities are not supposed to act as recovery agents.

The Deputy Commissioner of Police in-charge of Amherst Street Police Station would ensure that over the issue until and unless a case is registered there should not be any interference with the life and liberty of the petitioner.

With the aforesaid observations, the writ petition being WPA 22029 of 2025 is disposed of. A copy of the report be handed over to the learned advocate appearing for the petitioner. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
