His further appearance before this Court, for the day, is dispensed with.

The petitioner complains that inspite of being a physically handicapped person, she is unable to use the public tube well for availing water supply because of the private respondents who are creating circumstances for which she - being a disabled person, is unable to use

necessary amenities of usages of the water.

The attention of this court is drawn to the earlier order passed in WPA 12597 of 2022, wherein directions were passed upon the private respondents for not creating any disturbances in respect of usages of water facility.

State has submitted a report which reflects that a proceeding under Section 126 of the BNSS has been drawn up.

In view of the proceeding under Section 126 of the BNSS having been drawn up, I direct that the police authorities would ensure that there is no breach of peace and tranquility.

Learned advocate for the respondents submits that since affidavits have not been invited, other allegations made in the writ petition are deemed not to have been admitted.

With the aforesaid observations, WPA 22102 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.
