29.09.2022 dd/ct 28 C.R.M. (DB) 3382 of 2022 sl no. 69 (Rejected) In Re : An application for bail under section 439 of the Code of Criminal Procedure in connection with Murutia Police Station Case No. 98 of 2022 dated 18.07.2022 under sections 363/365/34 of the IPC adding Section 6 of the Protection of Children from Sexual Offences Act, 2012[POCSO case NO. 23/2022] .
And In Re : Raju Sk. @ Shaikh ........ petitioner Mr. Asraf Mandal ...... for the petitioner Mr. Arijit Ganguly, Mr. Sanjib Kr. Dan, ...... for the State Petitioner is in custody for 142 days. He renews the prayer for bail.
Learned lawyer for the State opposes the prayer for bail. We have considered the materials on record including the statement of the victim girl. Her statement shows that she was forcibly ravished by the petitioner.
Under such circumstances and in view of the gravity of the offence, we are not inclined to grant bail to the petitioner at this stage.
Accordingly, the prayer for bail is rejected. (Ajay Kumar Gupta, J.) (Joymalya Bagchi, J.)
