Ashok Chowdhury @ Ramesh Prajapati v. State Of West Bengal

29.09.2022 sdas rejected C.R.M.(DB) No. 3376 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with New Alipore Police Station Case No. 277 of 2016 dated 19.10.2016 under Sections 395/397 of the Indian Penal Code and under Section 25(1B)(a)/27 of the Arms Act.

And In Re : Ashok Chowdhury @ Ramesh Prajapati @ Chowdhury ..... petitioner Mr. Subhajit Chowdhury ... for the petitioner Mr. Madhusudan Sur, learned APP Mr. Manoranjan Mahata ... for the State Learned Counsel appearing for the petitioner submits he is in custody for five years and five months. He prays for bail. Learned Counsel appearing for the State opposes the prayer for bail and submits report with regard to the status of the case.

From the report it appears petitioner and co-accuseds have been contributed to the delay also. There are ample evidence connecting the petitioner with the alleged offence of dacoity.

Keeping in mind the aforesaid facts and as trial is in progress, we are not inclined to grant bail to the petitioner. The application for bail is, thus, rejected.

We direct the trial court to expedite the trial and conclude the same at an early date without granting any unnecessary adjournment to either of the parties. (Ajay Kumar Gupta, J.) (Joymalya Bagchi, J.)
