Learned advocate appearing for the petitioner submits that the private respondents have been duly served.
In spite of service none appears for the private respondents.
The petitioner claims that the portion of a PWD road has been encroached by the private respondents. Petitioner submitted representations before various authorities including the Assistant Engineer, PW (Roads) Department.
Learned advocate appearing for the petitioner submits that in spite of receipt of such representation no steps have been taken by the respondent authorities till date.
Mr. Dhole, learned advocate appearing for the State submits that immediately upon receipt of such representation, the concerned Assistant Engineer, PWD, Tamulk Sub-division by a letter dated August 28, 2025 requested the Block Land and Land Reforms Officer, Panskura - I to demarcate the property in question and provide the sketch map and ROR of PWD land at LR plot nos. 364, 374 and 384 adjacent to LR Plot No. 439, within Mouza - Dakshin Gopalpur under Panskura - I, PS - Panskura, District - Purba Medinipur.
Mr. Dhole, in his usual fairness, submits that the demarcation is yet to be done by the concerned BL&LRO. He submits that the demarcation work will be completed within the time limit that may be fixed by this court.
In the light of the submissions made by the learned advocates appearing for the respective parties, the Block Land and Land Reforms Officer, Panskura - I is directed to complete the work of demarcation as per the request made by the Assistant
Engineer, PWD, Tamluk Sub-division, prepares a report along with a sketch map and ROR of PWD land, and forward the report to the officer authorized to act under Section 10 of the Highways Act, 1964, within a period of four weeks from the date of receipt of a server copy of this order.
Immediately upon receipt of the report from the concerned BL&LRO, being the 8th respondent, the authorized officer shall take necessary steps in accordance with Section 10 of the West Bengal Highways Act, 1964 and to complete the entire exercise as expeditiously as possible, but positively within a period of four weeks from the date of receipt of the copy of the report from the authorized officer. With the above observations and directions this writ petition stands disposed of.
