The matter has been accommodated in the list on being mentioned by the learned advocate appearing for the petitioner.
It has been submitted by Mr. Saha, learned advocate representing the petitioner that sole petitioner is not willing to proceed with the writ petition and in support of the same letter dated 5th December, 2022 received from the petitioner addressed to the present advocate on record is placed before this Court and the same is taken on record. In addition thereto pursuant to the order dated 29th November, 2022 passed by this Court Mr. Saha, has filed Vakalatnama in the department and copy of the document issued by the concerned department of this Court wherefrom it appears that Vakalatnama was filed on 21st November, 2022, such copy of the document and the copy of the Vakalatnama are also placed before this Court which are taken on record.
In view of aforesaid submission being made on behalf of the petitioner, the writ petition stands dismissed on the ground of non-prosecution with liberty to the petitioner to file afresh with better particulars, if so advised. Interim order, if any stands vacated.
