Kashinath Banerjee v. State Of West Bengal & ANR.
02.08. 2022 item No.62 n.b.
ct. no. 34 CRR 3433 of 2007 With IA No. CRAN 2 of 2008 (Old No. CRAN 815 of 2008) Kashinath Banerjee Vs.
State of West Bengal & Anr.
Mr. Aritra Bhattacharya .....for the Petitioner Mr. Arijit Ganguly, Mr. Sandip Chakraborty, .....for the State The revisional application was preferred challenging the proceedings of B.G.R. Case No. 939 of 2007 arising out of Regent Park Police Station Case No.36 dated 20.3.2007 passed by the Chief Judicial Magistrate, Aliopore taking cognizance of the offence after charge-sheet was filed by the Investigating Agency under Sections 498A/406/313 of the Indian Penal Code.
As none appears on behalf of the State, Mr. Sandip Chakraborty, learned advocate, who ordinarily appears for the State is directed to appear in this mater and represent the State. His appointment may be regularized by the concerned authority.
Record reflects that the interim order expired in the month of March 2008, more than fourteen years have passed since then and the Learned Advocate appearing for the
petitioner is unable to appraise this court regarding the present stage of the proceedings.
Having regard to the same, I direct that if the proceedings are still pending Learned Trial Court would grant opportunity to the petitioner to agitate the points canvassed in the revisional application at the appropriate stage of the proceeding.
With the aforesaid observations, CRR 3433 of 2007 is disposed of.
All pending connected applications, if any, are consequently disposed of.
Interim order, if any, is hereby vacated.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. ( Tirthankar Ghosh, J.)
