Tanuja Khatun @ Bibi v. State Of West Bengal
10/11/2025 D/L - 41 Court No.28 S. Kundu Allowed C.R.M.(A) 3338 of 2025 In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Suri P.S. Case no. 322 of 2025 dated 2.6.2025 under Sections 85/80/108/3(5) of the BNS and 3 and 4 of the D.P. Act. In the matter of: Tanuja Khatun @ Bibi
...Petitioner.
Mr. Ashraf Ali Mr. Rafikul Islam Sardar ...for the petitioner.
Ms. Baisali Basu Mr. Asif Dewan ...for the State.
1. Leave is granted to the petitioner to amend the cause title.
2. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the married sister-inlaw of the alleged victim. The marriage between the couple took place four years ago. For the last six months the couple was residing separately. The husband has now been granted bail. The parent-in-law and the brothers-in-law were granted anticipatory bail by this Court on 6.11.2025 in CRM(A) 3323 of 2025. The petitioner stands on the same footing.
3. Learned counsel appearing for the State opposes the prayer for anticipator bail. He refers to the materials
available in the case diary including the statement of a neighbour.
4. Even the statement of the neighbour gives a clear indication that the petitioner was staying separately from the couple in question for some time.
5. Considering the materials available in the case diary, the alleged role ascribed to the petitioner, the fact that the principal accused being the husband was arrested and was thereafter, granted bail and that the three other coaccused were granted anticipatory bail by this Court, I do not think that custodial interrogation of the petitioner is required in this case and I am inclined to grant anticipatory bail to the petitioner.
6. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioner shall cooperate with the investigation and shall not threaten or intimidate the witnesses.
7. Accordingly, the application for anticipatory bail is allowed.
8. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
