The petitioner alleges that no steps have been taken by the police authorities pursuant to the complaint lodged by the petitioner with the Officer-in-Charge, Dumdum Police Station by a letter dated September 2, 2024.

The learned advocate for the State seeks time to take necessary instructions in this regard. Since the complaint has been lodged, it is the duty of the police authorities to take steps in accordance with law. If the complaint discloses a cognizable offence the police authorities is dutybound to take steps in accordance with law and register an FIR. If the said authority decides against registration of an FIR, the reasons therefore

are to be communicated to the petitioner within a period of two weeks from the date of receipt of the server copy of this order.

The learned advocate appearing for the State submits that the notices under Section 160 CrPC have been served upon the petitioner in connection with an investigation with regard to an incident that took place in the State of Bihar. The report of the Inspector-in-Charge, Dumdum Police Station dated September 27, 2024 filed in Court today is taken on record. It is further clarified that the investigation carried on in connection with Town Police Station, Nawada, Bihar shall not in any manner be affected by the order passed by this Court directing the police authorities to take a decision with regard to the compliant made by the petitioner vide letter dated September 2, 2024. The learned advocate appearing for the petitioner submits that his client will cooperate with the investigation in connection with Town Police Station, Nawada, Bihar. Such submission is placed on record.

With the above observations and directions the writ petition stands accordingly disposed of.
