Learned counsel for the CESC Limited submits that although the CESC Limited has taken all necessary steps for giving the electricity connection to the petitioner and installation of required equipment, subsequently a joint inspection with the KMC was followed up by a communication by the KMC authorities on the basis of a Circular issued by the KMC, bearing Circular No.01 of 2022-23 dated June 13, 2022, indicating that, apart from extremely emergent or essential work, separate approval has to be obtained from the Municipal Authorities prior to disturbing any carriageway and footpath during the embargo period up to October 31, 2022.

It is evident that the said embargo has been imposed by the KMC due to the upcoming festivities on the occasion of Durga Puja and other festivals of the State.

Learned counsel appearing for the petitioner takes a reasonable stand and submits that at least immediately after the embargo is over, the work may be done, so that the petitioner get the electricity connection-in-question. Upon considering such submissions, WPA 22385 of 2022 is disposed of by directing the CESC Limited to commence the required work for giving the electricity connection to the petitioner, for which the petitioner has already complied with necessary formalities, on and from November 1, 2022.

It is expected that the said work will be concluded and the electricity connection be given to the petitioner latest by November 18, 2022.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
