AD 20 November 17, 2025 Ct. 28 SG CRM(A) 3340 of 2025 Reject An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Raghunathganj Police Station Case No.193 of 2024 dated 25.02.2024 under Sections 143/144/147/148/149 /325/326/307/427/120B/34 of the IPC.

Haikul Sk @ Haikul Islam and others ... petitioners Mr. Kunal Ganguly ... for the petitioners Mr. Anand Keshari Mr. Debanshu Ghorai ... for the State Learned counsel for the petitioners submits that a fight took place between two groups. Over this incident three FIRs have lodged. The first one is suo motu. The victim was shown as an absconder. There were case and counter case. No specific role has been ascribed to the present petitioners. Learned counsel for the State strongly opposes the prayer for anticipatory bail, refers to the statements of witnesses including the victim where all the petitioners have been named as the assailants. He also refers to the injury report which shows cut injury on right finger which had to be amputated and three injuries on the scalp. The petitioners had to be hospitalised and medically treated there for a few days.

Considering the incriminating materials available in the case diary including the statement of the victim and the injury report, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
