CONSTITUTIONAL WRIT JURISDICTION APPELLATE SIDE

08. 11. 2024 BP Sl. 27 Court No. 14 WPA 22746 of 2024 Bikash Das Vs.

The West Bengal State Electricity Distribution Company Limited(WBSEDCL) & Ors.

Mr. Subhajit Chowdhury ..for the petitioner Ms. Gopa Roy ..for WBSEDCL Ms. Sipra Majumdar Ms. Prativa Ghatak ..for the State Mr. Gazi Faruque Hossain Ms. Varsha Roy ..for the respondent no.7

1. Affidavit of service filed in Court today is taken on record.

2. The petitioner is aggrieved by the inaction on the part of the Distribution Company Limited in taking steps for consideration of the representation filed on his behalf praying for restraining the authority from providing any electricity connection for operating submersible pump in favour of the private respondent.

3. Learned advocate representing the private respondent submits that the place where the connection has been sought for is a safe zone and there is no bar in obtaining electricity for operating submersible pump.

4. Learned advocate representing the licensee has placed before this Court a list of blocks categorized as critical and semi-critical as per GWRE of West Bengal, 2022-23. It appears therefrom that the block where the petitioner is enjoying electricity connection and the place where the private respondent has obtained electricity connection does not fall either within the critical or the semi-critical zone.

5. The aforesaid implies that there is no bar in granting electricity connection to the applicant.

Electricity connection has already been given to the private respondent as per the application made by the wife of the private respondent.

6. In view of the above, the prayer sought for by the petitioner cannot be allowed. The writ petition fails and is hereby dismissed.

7. The documents handed over by the learned advocate representing the Distribution Company Limited be retained with the records.

8. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
