29.09.2022 sdas rejected C.R.M.(DB) No. 3369 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Malipanchghora Police Station Case No. 136 of 2022 dated 20.07.2022 under Sections 272/273/304/120B of the Indian Penal Code read with Section 46AA of the Bengal Excise Act.

And In Re : Nemai @ Nimai Biswas .... petitioner Ms. Rupsa Sreemani ....for the petitioner Mr. T. D. Nandy Mr. Antarikhya Basu ...... for the State Learned Counsel appearing for the petitioner submits he is in custody fr 67 days. It is also submitted that there is no way to sell adulterated country liquor.

Learned Counsel appearing for the State opposes prayer for bail.

Having considered materials on record prima facie disclosing involvement of the petitioner in selling illicit country liquor which cause death of number of persons. Under such circumstance and in view of gravity of the offence, we are not inclined to grant bail to the petitioner at this stage.

The application for bail is, thus, rejected.
