Learned Counsel for the petitioner submits inspite of direction given by this Court to register FIR under provisions of Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, but said offences have not been added to the charge-sheet.

It is open to the petitioner to agitate his grievance before the jurisdictional Magistrate and in the event the Magistrate is of the view offences under the Special Act are disclosed the Magistrate shall transit the case to the Special Court for trial in accordance with law.

With this observation the application is disposed of.
