AD 19 November 17, 2025 Ct. 28 SG CRM(A) 3339 of 2025 Reject An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Raghunathganj Police Station Case No.194 of 2024 dated 25.02.2024 under Section 341/325/326/307/34 of the IPC.

Mr. Kunal Ganguly ... for the petitioners Mr. Arijit Ganguly Mr. Aritra Bhattacharya ... for the State Learned senior counsel representing the petitioners submits that a fight took place between two groups. Over this incident three FIRs were lodged. The first one was started suo motu. The victim was shown as an absconder. Then, there were case and counter case. No specific role has been ascribed to the present petitioners.

Learned counsel for the State strongly opposes the prayer for anticipatory bail, refers to the statements of witnesses including the victim where all the petitioners have been named as the assailants. He also refers to the injury report which shows cut injury on right finger, which had to be amputated and three injuries on the scalp. The victim had to be hospitalised and medically treated there for a few days.

Considering the incriminating materials available in the case diary including the statement of the victim and the injury report, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
