Learned advocate for the petitioners submits as follows. The petitioners are the owners of the property in question. The private respondents are disturbing the peaceful possession and enjoyment of the property of the petitioners. This was brought to the notice of the police, but no steps were taken.

Learned advocate for the State relies on the report and submits that the petitioners are the owners of the property in question. The police have acted on the complaints made by the petitioners by initiating a proceeding under Section 107 of the Code.

No further order need be passed in this regard. However, the police shall keep a sharp vigil at the locale and ensure that no breach of peace takes place. As affidavits were not called for, the allegations made are deemed not to have been admitted.

With these observations, the writ petition is disposed of.
