The petitioner is directed to serve a copy of the revisional application upon Mr Begg who usually represents the State. His appearance may be regularised by the concerned authorities. The petitioner has sought for quashing of the proceedings of ACGR Case No.5930 of 2018 arising out of Garfa PS Case No.472 of 2018 dated December 7, 2018 pending before the learned Judicial Magistrate, 10th Court at Aliopore. The revisional application encloses FIR, charge-sheet and the statement of the witnesses. I have considered the same and also the stage of the case, which is at the stage of consideration of charges.

Having regard to the stage for which the matter has been pending before the learned Magistrate for a considerable period of time, I direct the petitioner to exhaust the remedies under section 239 CrPC and thereafter approach this court.

With the above observations, CRR No.3499 of 2023 stands disposed of. Pending application, if any, stands also disposed of.

Parties are to act on the server copy of this order duly downloaded from the official website of this court. Certified copy of this order, if applied for, shall be made available to the parties.
