With CAN 1 of 2025 Mr. Nikhil Kumar Gupta Ms. Laboni Bar Ms. Doyel Mondal ....for the review applicant Mr. Tarak Nath Halder ....for the opposite party The learned advocate for the petitioner submits that there is an error apparent on the face of the record as the review applicant is in possession of the property in question.
This Court in the order under review has specifically recorded that the possession of the plaintiff/petitioner in the suit lands in not disputed by the opposite party in the civil revision application and it has also been admitted by the opposite party that after marriage of Shibani Joddar, Tapan Gayen i.e. the predecessor of the plaintiff was cultivating the suit lands on behalf of Shibani Joddar and the name of Tapan Gayen in the L.R. Record of Rights as Bargadar.
Thus this Court does not find any error apparent on the face of the record.
Accordingly, RVW 295 of 2025 along with CAN 1 of 2025 stands dismissed.
There will be no order as to costs.
