AD 72 November 7, 2025 Ct. 28 SG CRM(A) 3343 of 2025 Partly Allowed An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Murshidabad P.S. Case No.297 of 2025 dated 03.04.2025 under Sections 117(2)/126(2)/74/110/3(5) of the BNS, 2023.

Uttam Mondal @ Uttam Mandal and others ... petitioners Mr. Debapriya Samanta Ms. Riya Saha Mr. Suhotro Palit Mr. Akash Kumar Chakraborty ... for the petitioners Ms. Sayanti Santra Ms. Suruchi Saha ... for the State Learned counsel for the petitioners submits that a scuffle took place between the two groups of neighbours resulting in stone pelting amongst each other. However, the application is not pressed so far as the petitioner No.2 is concerned as he was arrested and thereafter granted bail.

Learned counsel for the State opposes the prayer for anticipatory bail, relies on the statements of the victim and other witnesses and the injury report showing scalp injury among other things.

On the prayer of learned counsel for the petitioners, the application for anticipatory bail is dismissed as not pressed so far as the petitioner No.2(Ujjal Mondal @ Ujjal Mandal) is concerned.

Considering the materials available in the case diary and the alleged roles ascribed to the present petitioners while I am inclined to grant anticipatory bail to the petitioner No. 4, the application for anticipatory bail of the petitioner Nos.1 and 3 (Uttam Mondal @ Uttam Mandal and Utpal Mondal @ Utpal Mandal) is rejected.

In the event of arrest, the petitioner No.4 (Manoranjan Mandal @ Manoranjan Mondal @ Monoranjan Mandal) shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further conditions that the petitioner No.4 shall meet the investigating officer once a week till submission of report in final form, shall cooperate with investigation and shall not threaten or intimidate witnesses. The application for anticipatory bail is, thus, disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
