And In Re : Khitish Biswas @ Jiban ..... petitioner.

Ms. Puja Goswami ... for the petitioner Mr. S. S. Imam Mr. Arabinda Manna ... for the State Learned Counsel appearing for the petitioner submits the petitioner is in custody for 62 days. He prays for bail. Learned Counsel appearing for the State opposes the prayer for bail.

We have considered materials on record including statement of the minor victim. Her statement implicates the petitioner in the offence of penetrative sexual assault. Keeping in mind the aforesaid increminating materials and the gravity of the offence, we are not inclined to grant bail to the petitioner at this stage.

The application for bail is, thus, rejected.
