Present petition has been filed for expeditious disposal of Case No. CN/3592/2023 under Section 138 of the Negotiable Instruments Act pending before the learned Metropolitan Magistrate 12th Court, Calcutta.

Learned counsel for the petitioner submits that the complaint was filed in October, 2023 and till date evidence has not started. Learned counsel submits that petitioner is an old man of around 70 years of age and, therefore, directions may be issued for expeditious disposal.

The court has considered the submissions. Apparently there is a delay in conducting the proceeding, which is contrary to intention of the legislature of summary trial of such cases. No prejudice will be caused to the other party if an appropriate directed is issued for the expeditious disposal. 4.

Thus, taking into account and facts and circumstances, learned trial court is requested to conduct the proceedings

expeditiously without any further delay in accordance with the statutory provision. No unnecessary adjournments be granted. In case the court is vacant, the petitioner shall be liberty to make an appropriate application before the concerned court. 5.

Accordingly, CRR 4205 of 2025 stands disposed of. 6.
